Terms and Conditions

1. Studio Lumaé provides photography, videography, social content, digital media production and related creative services for real estate and lifestyle brands.
2. Studio Lumaé operates under an obligation of best effort (inspanningsverplichting): we commit to carrying out the work professionally and diligently, but do not guarantee specific commercial outcomes (e.g., sales, bookings, engagement, traffic or rankings), unless explicitly agreed in writing.

1. Services and Engagement

Studio Lumaé, a trade name of Estrella Concepts S.L., registered in Spain with CIF: B75650119, with registered office in Cometa II 20c, 03710, Calpe, Spain, hereinafter referred to as “Studio Lumaé”, and the contracting party hereinafter referred to as “Client”.
These Terms apply to all quotations, proposals, agreements and services provided by Studio Lumaé.

1. These Terms are governed by Spanish law.
2. Any disputes shall be submitted to the competent court in Alicante, Spain.

Studio Lumé – General Terms and Conditions

1. Upon full payment, the Client receives a non-exclusive, non-transferable license to use the delivered Content for the promotion, marketing and/or sale of the property or brand for which it was commissioned.
2. The license is limited to the agreed channels, region and purpose. Any additional usage (e.g., other brands, new campaigns, resale, sublicensing, third-party distribution) requires separate written permission and may incur additional fees.
3. RAW / source files (e.g., RAW photos, project files, unedited footage) are not included and are not delivered unless agreed beforehand, at additional cost.

2. Use of Content by Client

1. The Client grants Studio Lumaé a perpetual, worldwide, and royalty-free license to use the created Content for self-promotion, including but not limited to: website, portfolio, social media, presentations, case studies and award submissions.
2. If the Client has a strong and legitimate confidentiality concern (e.g., property not yet officially listed), a temporary embargo may be agreed in writing before production.

3. Use of Content by Studio Lumaé (Portfolio & Promotion)

1. Unless otherwise agreed: 50% deposit upon confirmation and 50% upon delivery.
2. Final Content may be delivered with watermark until full payment is received.
3. In case of cancellation:
Within 5 business days of the shoot → 50% of the project fee.
Within 48 hours of the shoot → 100% of the project fee.
4. External costs (e.g., location fees, stylists, permits) are always billed at cost and are non-refundable.

8. Payment Terms

1. All intellectual property rights remain with Studio Lumaé, unless explicitly transferred in writing.
2. Unauthorized use of the Content, including usage before payment or beyond licensed scope, incurs a fee equal to 200% of the applicable licensing rate, without prejudice to Studio Lumaé’s right to claim full damages.

9. Intellectual Property

1. If Studio Lumaé manages or handles social media accounts or advertising data on behalf of the Client, a separate Data Processing Agreement (DPA) will be signed where required.
2. Both Parties commit to complying with applicable data protection laws.

10. Data Protection (GDPR)

1. The Client shall ensure the location is clean, staged, accessible and photo-ready at the scheduled time.
2. Delays caused by lack of access, on-site preparation or waiting time may result in additional charges.

7. Client Responsibilities

1. The Client is responsible for ensuring that all necessary permissions have been obtained from property owners, tenants, HOAs, brand owners, and/or individuals present in the footage.
2. The Client indemnifies Studio Lumaé against any claims arising from missing or insufficient permissions.

4. Property, Model & Third-Party Rights

1. If drone footage is requested, the Client is responsible for providing accurate location information and confirming that filming is permitted.
2. If authorization is denied or restricted, Studio Lumaé is not liable for resulting limitations. Alternative footage or rescheduling may incur additional fees.

5. Drone Usage & Local Regulations

1. Delivery is made in the file formats agreed.
2. The Client shall review the delivered Content within 5 business days. If no feedback is provided within this period, the Content is considered accepted.
3. Each project includes one (1) reasonable revision round for light adjustments (e.g., cropping, color balance). New creative requests, restyling, rescoring, or structural edits count as additional work and will be billed.

6. Delivery, Review & Revisions

1. Studio Lumaé’s liability is limited to the amount invoiced for the specific project in question.
2. Studio Lumaé is not liable for indirect or consequential damages, including loss of profit, opportunity or reputation.
